Terms of Service

These Terms of Service govern the provision of services by FSB Web Solutions, operated by Ina Damyanova. By requesting, ordering, or using services, the client agrees to these terms.

1. Service Provider

Services are provided by:

2. Scope of Services

FSB Web Solutions provides digital services including but not limited to:

  • Website creation and setup
  • Landing pages and small business websites
  • Website updates and fixes
  • Technical configuration
  • Domain and hosting setup assistance
  • Related digital services

The exact scope of each project is defined in the individual quote, offer, or written agreement. Any work outside the agreed scope is billed separately.

3. Offers and Acceptance

All offers and quotes:

  • Are non-binding until accepted by the client
  • May include a validity period
  • Are considered accepted when confirmed in writing (including email)

Work may start only after acceptance and any required advance payment.

4. Client Responsibilities

The client agrees to:

  • Provide accurate and complete information
  • Deliver required materials (texts, images, logos, credentials) on time
  • Hold the necessary rights for all provided content
  • Review and approve drafts within reasonable time

Delays in client input may extend delivery timelines. The client is responsible for the legality of all provided materials.

5. Pricing and Payment Terms

Prices are stated in the quote or offer.

Payment structures may include:

  • Full prepayment
  • Deposit plus final balance
  • Hourly billing
  • Milestone billing

Payment is made after receiving an invoice or proforma invoice. Bank and payment details are provided only on the invoice.

Work may be paused if invoices are overdue.

6. Proforma Invoices

A proforma invoice may be issued before work begins. Where applicable, work starts after the proforma invoice is paid, unless otherwise agreed in writing.

7. Hours Worked and Early Project Termination

If a client cancels or stops a project after work has started:

  • All hours already worked are billable
  • Partial work and drafts may be delivered after payment
  • Deposits are non-refundable once work has begun

Time spent on consultation, setup, and preparation is considered billable work.

8. Fixed-Price Projects

For fixed-price services:

  • Scope is limited to what is listed in the offer
  • Included revisions are limited to those specified
  • Additional changes are billed separately at an hourly rate

Requests outside the defined package are treated as extra work.

9. Refund Policy

Because services are custom and digital in nature:

No refunds are provided for:

  • Hours already worked
  • Delivered digital products
  • Completed or partially completed websites
  • Setup and configuration services

Partial refunds may be considered only if no substantial work has started and nothing has been delivered.

10. Recurring Services

Recurring services may include:

  • Hosting
  • Domain renewals
  • Maintenance plans
  • Support retainers

Recurring services are billed in advance on a monthly or yearly basis.

Non-payment may result in suspension or termination of the related service. Third-party costs are non-refundable once purchased. Cancellation must be requested before the next billing cycle.

11. Third-Party Services

Projects may involve third-party providers such as hosting companies, registrars, platforms, or plugins.

FSB Web Solutions is not responsible for:

  • Third-party outages
  • Platform changes
  • License rule changes
  • External service failures

Third-party terms and conditions also apply.

12. Delivery and Acceptance

A project is considered delivered when:

  • It is published online, or
  • Files or access credentials are provided to the client

The client has 5 business days to report issues related to agreed scope. After that period, the work is considered accepted.

13. Intellectual Property

After full payment:

  • The client receives usage rights to the final deliverable
  • FSB Web Solutions may display non-confidential work in its portfolio

All unpaid work remains the property of FSB Web Solutions.

14. Limitation of Liability

Liability is limited to the amount paid for the specific service.

No liability is accepted for:

  • Indirect damages
  • Loss of profit
  • Business interruption
  • Client content violations
  • Third-party failures

15. Service Availability

Continuous availability of websites, hosting, or platforms cannot be guaranteed. Reasonable effort is made to maintain continuity.

16. Termination

Services may be suspended or terminated if:

  • Terms are breached
  • Payments are overdue
  • Cooperation becomes impossible

All work performed up to termination remains payable.

17. Governing Law

These Terms are governed by applicable EU and Belgian law.

18. Updates

These Terms of Service may be updated when necessary. The latest version applies to new orders and is published with the revision date.
